End User License Agreement
End User License Agreement (EULA) - By downloading any material content published at Majestic Art Productions ("You" or "Buyer") agree herein (the "Terms") to the terms of this legally binding agreement in its entirety. By using the Website or Service you accept these terms.
Content For Sale - Refers to any material published for sale by content creators at Majestic Art Productions including but not limited to models, textures, collections, packages, products, audio, music, words, videos and images. At the point of purchase or free download your license becomes valid. If sale is reversed by Buyer (the "Refund") for any reason, all license rights are terminated without notice and must immediately destroy any and all copies contained on any type of media under the control or possession.
Member - Refers to any person who creates a user account at Majestic Art Productions.
Rights Granted - Buyer is granted a non-exclusive, worldwide, license to use material content in any medium physical or digital now known or later invented and can publicly perform, publicly display, broadcast or transmit for promotional and commercial purposes. Buyer printing rights to publish content within a book, poster, t-shirt, doll, toy or other physical model. You must incorporate downloaded content into your audio, visual or printed works.
Restrictions - Resale or redistribution of downloaded content, whether in part or in whole, is prohibited unless it is used as incorporated content as licensed above. You cannot sell the incorporated content on marketplace stores or for other users to re-package goods for distribution or to be sold inside a virtual game world. Certain rights greater than that contained in the EULA are excluded and those copyrights remain the property of the Seller.
Ownership - Seller retains ownership of the copyrights and all other material content rights. Seller is free to grant similar rights to others during and after the term of this agreement.
Termination - This agreement may be terminated at any time by either party upon written notice via email or regular mail.
Indemnity - You agree to indemnify and hold Majestic Art Productions and its subsidiaries, affiliates, shareholders, officers, directors, agents, licensors, licensee, suppliers, alliance members, ohter partners, employees and representative (MAP Parties) harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of our content. Majestic Art Productions reserves the right at any time to modify, suspend or terminate the services and/or your use of or access to them without notice. Majestic Art Productions will not be liable to you or any third party for any modification, suspension or termination of services or loss of related information. Majestic Art Productions may amend these Terms at any time without notice as, all terms and conditions will be posted on this URL and should be consulted by you prior to use. This agreement will be governed by California law. Any action or proceeding arising out of or related to this agreement must be brought, in a state or federal court located in San Diego, California, and both parties irrevocably submit to the exclusive jurisdiction of such courts. All notices, requests and other communications under this agreement must be in writing by email.
